By creating an account, uploading content, or otherwise using ThePicStore.com and related apps (the "Services"), you agree to these Terms of Use (the "Terms") and our Privacy Policy. If you do not agree, do not use the Services. This is a plain‑English summary; the Terms control in any conflict.

1) The Services; Hosting Only Role

We provide data‑hosting and delivery tools for photos, videos, and files, including storage, sharing links, and gallery presentation. We do not control, endorse, or monitor user content and are not responsible for it. We may provide optional third‑party integrations (e.g., print providers, payment processors).

2) Eligibility

You must be 18 or older and capable of forming a binding contract to use the Services.

3) Account, Security & Notifications

• Provide accurate registration information and keep credentials secure.
• You are responsible for all activity under your account.
• We may send service, security, and legal notices electronically.

4) Your Content; Ownership & License

• Ownership: You (or your licensors) retain ownership of your content.
• License to Us: You grant us a non‑exclusive, worldwide, revocable, limited license to host, store, reproduce (for technical operations and backups), transmit, display, and distribute your content solely to operate and improve the Services and as you configure (e.g., shared links, downloads).
• Permissions: You must have all necessary rights and consents (e.g., model releases, minors’ guardians, copyright licenses).

5) Absolutely Prohibited Content & Conduct

You may not use the Services to post, share, or facilitate content or activity that is illegal, unsafe, or harmful, including (non‑exhaustively):

• Child sexual abuse/exploitation or any sexual content involving minors
• Non‑consensual intimate imagery; stalking, doxxing, threats, or harassment
• Terrorism, violent extremism, or incitement of violence
• Content that facilitates self‑harm or harm to others
• Malware, phishing, spam, or attempts to compromise security
• Infringing content (copyright, trademark, or other IP), including pirated material
• Obscene or pornographic material where prohibited by law
• Any activity that violates laws/regulations or others’ privacy rights

Enforcement: Although we do not proactively monitor content, we may remove or restrict content, suspend accounts, or notify authorities where we have a good‑faith belief that content or activity violates these Terms or the law, or upon valid legal notices (e.g., DMCA).

6) Copyright Policy (DMCA)

We honor the U.S. DMCA. To report alleged infringement, email our DMCA Agent at dmca@thepicstore.com with a notice containing: (a) identification of the copyrighted work; (b) identification and URL/location of the allegedly infringing material; (c) contact information; (d) a good‑faith statement; (e) a statement under penalty of perjury; and (f) your signature. Counter‑notification is available under 17 U.S.C. §512(g). We may terminate repeat infringers.

7) Third‑Party Services & Commerce

If you connect prints, payments, analytics, or other integrations, those are provided by third parties under their own terms and privacy policies. We are not a party to your transactions with third‑party vendors unless expressly stated.

8) Privacy

Your use of the Services is governed by our Privacy Policy.

9) Service Changes; Storage Limits

We may modify, suspend, or discontinue features, impose or change storage/transfer limits, or update pricing. We endeavor to provide notice where feasible.

10) Termination

You may terminate at any time through your account. We may suspend or terminate access for violations, legal risk, non‑payment, or to protect the Services. We are not obligated to monitor content but may act on credible reports or legal process.

11) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIC STORE LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13) Indemnification

You agree to defend, indemnify, and hold harmless Pic Store LLC from claims arising out of (a) your content; (b) your use of the Services; or (c) your violation of these Terms or applicable law.

14) Governing Law; Venue; Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflicts principles. Venue for any permitted court action lies in the state or federal courts located in Cook County, Illinois. (Optional: insert binding arbitration and class‑action waiver after legal review.)

15) Export & Sanctions Compliance

You agree to comply with all applicable export control and sanctions laws.

16) Changes to Terms

We may update these Terms and will update the "Last Updated" date. Continued use after updates constitutes acceptance.
